The 29 CFR Part 1614: Federal Sector Equal Employment Opportunity

The U.S. Equal Employment Opportunity Commission has amended the process through which federal employees report incidences of discrimination.

The changes include:

  • Enforcing the pre-existing requirement that agencies adhere to EEOC regulations, Management Directives, and Bulletins
  • Reaffirming the already existing requirement that agencies follow EEOC regulations, Management Directives, and Bulletins
  • Providing non-compliant agencies with EEOC notices
  • Granting pilot projects for EEO complaint processing
  • Requiring agencies provide a notice of rights to complainants when the investigation will take place over a prolonged period of time
  • Requesting agencies to submit complaint files and appeals documents in electronic formats
  • Allowing administrative judge decisions to be final if based on the merits of class complaints, with both parties able to appeal to EEOC
